Professor Popiołek is the head of the corporate, arbitration and international sales and trade law practice groups at the firm. He is also an active academic, a professor at the University of Silesia, and since 2006 has been Chair of the Department of Civil and Private International Law.

Professor Popiołek is one of the leading Polish authorities on corporate law and on private international law. His experience includes also law on international commerce and arbitration. He is the author of several commentaries and books, as well as numerous articles on aspects of these fields of law.

In his long-standing legal practice, Professor Popiołek has advised major corporations on many varied aspects of corporate and commercial law. He has produced dozens of legal opinions for domestic and international business entities, as well as for the state and local public authorities.

Professor Popiołek has served as a presiding arbitrator or a co-arbitrator in numerous arbitration proceedings, both international and domestic. He is an arbitrator at the Arbitration Court at the National Chamber of Commerce (KIG) and a member of the Arbitration Council of that Court. He has served as an arbitrator in proceedings at the ICC Court of International Arbitration, as well as at the Lewiatan Court of Arbitration, the Arbitration Court at the Association of Polish Banks, and the Arbitration Court at the Polish Central Securities Depository.

Representative experience:

  • Represented and advised one of the major European telecommunications company in a complex set of disputes relating to the shareholding in a Polish company, including proceedings aiming at recognition of an international arbitral award
  • Regularly prepares legal opinions and advises one of the chief Polish television networks on matters of corporate law and concerning international transactions of various types

Leszek Cholewa heads the white collar crime and criminal defence practice group of the firm. Mr Cholewa is an attorney with extensive experience in representing clients in proceedings before many types of courts, both in civil and criminal proceedings. In his practice he focuses on general corporate and commercial law. He advises companies and their managers, including businesses from the banking and financial sector.

Leszek Cholewa has considerable experience in the fields of banking, finance and securities law. Before founding ADP, Mr Cholewa worked for many years as a legal counsel for one of the largest Polish banks, where he took part in laying down the legal foundations for the functioning of the banking system during the economic transformation in Poland in the early 1990s. Mr Cholewa also lectured in banking law at the University of Economics in Katowice.

Leszek Cholewa has trained in France, where he practised with the Orders Des Advocates and at the Paris law firm Gide Loyrette Nouel.

Leszek Cholewa is an active member of the Katowice Bar. Since 2001, Mr Cholewa has represented the Regional Bar Council of Katowice, serving as a deputy to the National Bar Congress. He also gives lectures and seminars to trainees at the Regional Bar Council in Katowice.

Grzegorz Długi heads the real property practice group. In his practice, he concentrates on various aspects of real property and business law, including in particular negotiations of complex commercial contracts and structuring various project finance transactions and joint ventures. Over the years, he has gained a high reputation as a skilful business negotiator. He has also been involved in many greenfield investments, corporate M&A and real estate transactions, and has considerable experience in relations with administrative and regulatory authorities. Mr Długi has assisted clients in proceedings before regulatory authorities such as UOKiK (Office of Competition and Consumer Protection), URE (Energy Regulatory Office) and KNF (Financial Supervision Authority). He also advised on conclusion of contracts with various administrative bodies.

Mr Długi obtained his law degrees from universities both in Poland and in Australia.

Mr Długi also has public service experience. In 1991, Grzegorz Długi was appointed as a Consul in Chicago, and later Consul General and Counsellor to the Polish Embassy in Washington D.C. Additionally, he served as an advisor to Deputy Prime Minister of Poland.

Ewa Karkocha leads the labour law practice of the firm. She advises both large and medium size companies on various aspects of business law, including the general corporate and commercial law, tax law, labour law and dispute resolution. She has taken part in several due diligence procedures and numerous pre-privatisation analyses. On many occasions Ms Karkocha has advised clients in the sale of shares transactions.

Representative experience:

Krzysztof Kita heads the co-operatives and housing law practice group of the firm. He is an experienced business lawyer advising his clients on various issues in the fields of commercial and civil law. Mr Kita also has a deep knowledge of insurance law – he advises and represents before courts one of the major Polish insurance companies. He also possesses considerable expertise in medical law and his clients include various privately-owned medical institutions.

Mr Kita worked for many years as an in-house lawyer or director of the legal department in various companies in the Silesia region.

Dr Agnieszka Lizer-Klatka heads the construction and engineering practice group of the firm. Her practice also focuses on commercial law dispute resolution, both through litigation and arbitration.

Dr Lizer-Klatka possesses considerable experience in the civil engineering and construction industry, including complex agreements relating to large infrastructure and building projects, many of them based on the FIDIC terms of contracts. In the past, Dr Lizer-Klatka has assisted several business companies or state entities in various court proceedings involving construction law. Dr Lizer-Klatka also has considerable experience in unfair competition litigation. She has a record of successfully representing ADP’s clients in unfair competition proceedings based, among other things, on attempts by competitors or partners to take over the company’s clientele or employees.

In the field of arbitration, Dr Lizer-Klatka has both practical experience as well as a thorough theoretical knowledge. In 2014 she completed a Postgraduate Diploma in International Dispute Resolution at Queen Mary University of London. She serves as an arbitrator at the Lewiatan Court of Arbitration and the Arbitration Court at the Association of Engineers Advisors and Building Consultants (SIDIR).

Dr Lizer-Klatka benefits from considerable academic experience. She teaches civil and private international law at the School of Banking and Finance in Bielsko-Biała. In 1997 she was awarded a British Council scholarship to study at the University of Cambridge, Lauterpach Research Centre for International Law. She has published in the field of international commercial arbitration.

Agnieszka Maroszek-Kurowska is the leader of the firm’s public procurement practice group. Her experience comprises various areas of regulatory law, including in particular the law of public procurement. She has advised both investors and contractors in public procurement processes and represented clients in disputes arising in relation thereto.

Ms Maroszek-Kurowska has also gained considerable expertise in the field of capital markets and the stock exchange. She has advised publicly-traded companies with respect to various day-to-day legal issues arising in that regard. In addition, Ms Maroszek-Kurowska has provided comprehensive advice to a company making a public offer on the Polish stock exchange.

Agnieszka Maroszek-Kurowska regularly advises clients on various types of general civil and commercial law issues.

Mr Pichura heads the firm’s commercial litigation practice. He is an experienced attorney, practicing in various areas of corporate and commercial law, with a considerable knowledge of tax planning issues. For his clients he has performed a wide range of work relating to structuring transactions and dispute resolution before the courts. Mr Pichura has assisted in the liquidation process of companies active in the financial services sector, which involved experience with complex financial structures. He is also known as a talented defence counsel, acting in the past in some of the far-famed white collar crime cases.

Jerzy Rożek heads the general commercial and contract law practice of the firm. In the past he worked as an in-house lawyer in various companies in the Silesia region.

Mr Rożek is a legal advisor with more than 20 years of experience in assisting companies with various legal matters related to their business activity. His practice is focused on advising clients in structuring a wide range of commercial transactions. He also represents clients before courts in commercial litigation. His clients include important companies from the steel, energy, electrical and computer industries. He also advises a major Polish insurance company and a number of health establishments, including, in particular, public hospitals.

Mr Rożek is a skilful bankruptcy and restructuring law advisor. He has assisted numerous companies with their liquidation process, and has cooperated with bankruptcy trustees in various bankruptcy proceedings.

Mr Rusinek heads the tax and customs practice at ADP. He is both a tax advisor and an advocate at the Katowice Bar. He has considerable experience in tax, administrative and commercial law, and provides his clients with comprehensive legal advice that includes various aspects of commercial transactions, helping them to structure their businesses in the most efficient manner. Thanks to his thorough knowledge of tax law, he provides advice that includes the tax consequences of every transaction envisaged by business entities. He is also a criminal defence lawyer specialising in fiscal crimes.

In his practice, Mr Rusinek has prepared numerous opinions on various issues relating to tax law, and has gained particularly important experience with respect to value added tax. He has also worked on complex matters relating to funding provided under the EU structural funds.

Aleksandra Zawadzka-Kubica is an experienced litigation attorney and managing partner of the Bytom Office, where she leads the commercial law, restructuring and insolvency practices. Ms Zawadzka-Kubica started her career as a lecturer in criminal law at Silesian University, before moving to practice law as a full-time legal advisor in 1988.

Aleksandra Zawadzka-Kubica has many years of experience in advising business clients in various sectors of commercial activity. In particular, she has worked for undertakings from the coal mining, steel and construction and engineering sectors. She has represented clients (acting for an investor or for engineering companies) in numerous cases of litigation relating to planning and implementing engineering and construction projects. Tomasz Kędziora is a partner and the firm’s administrative director.

Mr Kędziora has an extensive business and managing experience, both in the engineering industry and more recently in the area of consulting services. In the past he has worked for ‘Główny Instytut Górnictwa’, ‘Zakłady Wytwórcze Urządzeń Sygnalizacyjnych’ and served as a Director of the Branch of the ‘CTHE UNITRA’. Mr Kędziora has also been a CEO of the ‘ACT sp. z.o.o’. in Katowice and ‘TWD SUD holding’ in Gliwice.

In his career Mr Kędziora has been a member of supervisory boards of various important companies in Southern Poland, including businesses from the mining, brewery, construction and manufacturing industries.

Jarosław Cholewa joined ADP in 2013, after being admitted to the Katowice Bar.

Jarosław’s practice concentrates on providing day-to-day advice for businesses on a wide range of legal issues. He drafts contracts and prepares opinions on various aspects of commercial and contract law. Jarosław provides legal advice for one of the largest producers of fire-proof materials.

Jarosław graduated from the Jagiellonian University in Krakow, as well as from the School of American Law run by the Jagiellonian University and the Columbus School of Law (Catholic University of America). Between 2007 and 2008, he was awarded an Erasmus scholarship to study at the Universitá degli Studi di Napoli “Federico II”. As a student, he took part in the Willem C Vis Commercial Arbitration Moot Court Competition (2008-2009).

Between 2010 and 2012, Jarosław completed his training as an advocate with the Regional Bar Council in Krakow. Jarosław then worked for one of the leading law firms in Krakow, where he was involved primarily in legal counsel for companies from the energy and construction industries. A graduate of the University of Silesia in Katowice, Tomasz joined ADP’s Bytom office in 2006. Between 2010 and 2013 he went through his advocate’s training with the Regional Bar Council in Katowice, which he completed with a merit. Since 2013 he has been an advocate at the Katowice Bar.

In his practice, Tomasz focuses chiefly on litigation, before civil and commercial courts, as well as criminal courts. Małgorzata Komander joined ADP in 2005. In 2008 she passed the state’s exam for judges, and since 2009 she has been enrolled at the bar of the Regional Chamber of Legal Advisors in Katowice.

Bartosz Krupa joined ADP in 2010, having graduated from the Faculty of Law at the University of Silesia earlier the same year. In 2014 he completed his advocate training and joined the Regional Bar Council in Katowice.

In ADP, Bartosz takes part in providing day-to-day legal advice to the dynamically growing companies from the construction and engineering industry. He primarily deals with various aspects of commercial contracts and corporate matters. Piotr Kuśnierz graduated from the Faculty of Law at the University of Silesia in 2008, and started to work for ADP in November of that year. He completed legal advisors’ training at the Regional Chamber of Legal Advisors in Katowice, and since 2013 has been admitted to the Bar.

Piotr Kuśnierz is involved in legal assistance in the day-to-day business affairs of companies and cultural establishments, and represents clients in legal proceedings before courts. In ADP, Piotr prepares legal opinions, drafts contracts and advises the clients on commercial contracts, both in Polish and English. Piotr also has considerable experience in competition law issues, gained while counselling clients from the coal mining industry on certain aspects of state aid law. Dr Maciej Zachariasiewicz is both an academic and a practicing lawyer. He joined ADP in 2007, and his practice focuses on arbitration, international dispute settlement and international commercial law. He has advised clients in arbitration proceedings before the International Court of Arbitration at the ICC, and the Arbitration Court at the Polish Chamber of Commerce. Maciej has prepared a number of legal opinions on issues of civil, commercial, international and European law. He has also advised Polish governmental authorities and state-owned companies.

Maciej is an active academic and an assistant professor at the Koźmiński University Law School in Warsaw. He teaches civil law and private international law, as well as international commercial law and international disputes settlement in Europe, both in Polish and English. For several years he has coached students for the Willem C. Vis International Commercial Arbitration Moot Court.

In 2009, Maciej defended a PHD thesis at the University of Silesia on the subject of trusts and fiduciary relationships in private international law. He publishes in the area of civil, private international, arbitration and European law.
